Her brother, an Air Force veteran, died in a shootout with Lay and his son, Christopher Douglas Lay, in an armed robbery at MidFirst Bank in Tulsa. Christopher Lay was sentenced to life without parole.

The court set an execution date of January 27 for Donald Anthony Grant. Grant was sentenced to death for the 2001 murders of Del City motel workers Brenda McElyea and Suzette Smith.

The court set an execution date of February 17 for Gilbert Ray Postelle. He was convicted of killing four people in 2005 outside of a trailer in Del City. He received the death penalty for two of the murders.

The court set an execution date of March 10 for James Allen Codington, who was sentenced to death for the 1997 murder of Albert Hale in Oklahoma County.

The action comes after the state suspended the death penalty following the botched execution of Clayton Lockett in 2014, the 2015 execution of Charles Warner using the wrong drug, a protocol review of lethal injection and litigation.

Twenty-six prisoners challenged the state’s method of execution in federal court. The case is pending.

“We are concerned that the court will set these dates after knowing that unresolved questions over Oklahoma’s lethal injection protocol remain unresolved in Federal District Court,” said Dale Baich, a federal advocate. Arizona deputy who represents Jones and worked on the lethal injection case. “Allowing executions when there is a chance that the federal court will find a constitutionally unacceptable risk that a person may suffer as a result of the combination of drugs used is deeply troubling. “
